Supreme Court says, Declare NEET 2017 Result

The Supreme Court today allowed the CBSE to declare NEET 2017 Result putting a stay on the Madras High Court’s order restraining publication of results. The top court asked CBSE to declare NEET 2017 results before 26 June. The CBSE had approached the top court regarding the declaration of results which had earlier been put on hold by the Madras High Court.

The CBSE on June 9 approached the Supreme Court against the High Court ruling, saying that because of the High Court order, the entire schedule of counselling and subsequent admission for medical courses through NEET has gone “haywire”.

However, a vacation bench of Justices P C Pant and Deepak Gupta said the declaration of results as well as the subsequent counselling and admission will be subject to the decision of the apex court in the matter pending before it.

The Supreme Court has also barred the high courts in the country from entertaining petitions on NEET. The High Court cannot tinker with the medical examination schedule, Supreme Court said. Supreme Court observed that the Madras High Court order was diluting the schedule for medical education fixed by Supreme Court’s 2011 judgment.

The apex court also directed the concerned authorities to proceed with the process of declaration of results, subsequent counselling and admission to MBBS and BDS courses as per the schedule fixed by it earlier.

The Madras High Court on 24th May 2017 stayed the declaration of results on finding that the NEET question papers for over 11 lakh students who took the examination in English and Hindi were the same, but they were different for those who wrote the test in eight vernacular languages.

The NEET notification had mentioned earlier that the results would be released on 8th June 2017.

Additional Solicitor General (ASG) Maninder Singh, representing the CBSE, had told the Supreme Court that the challenge to the different sets of questions in vernacular languages were on wrong assumptions that they were difficult as the experts had examined that they were different from those in English or Hindi medium but the level of difficulty cannot be said to be different.

He said that questions were different to keep the larger interest protected on the ground that if there was a leakage of a set of paper in a vernacular language, the majority of students would be protected as candidates appearing in any particular language were less than those opting for English or Hindi.

Singh also contended that a number of pleas have been filed in various High Court in NEET 2017 related matters and the HC have entertained these petitions despite the apex court’s order that no other court shall hear such matters.

Besides the CBSE, two students have also moved the Supreme Court to challenge the Madras High Court’s interim stay on the declaration of NEET 2017 results. They have contended that the future of 12 lakh NEET candidates is uncertain and there was an apprehension of loss of one semester in the MBBS courses due to delay in admissions.

NEET 2017 Statistics –

A total of 11,38,890 students appeared for the NEET exam including 1,522 non-resident Indians and 613 foreign nationals.

Around 10.5 lakh students appeared for the exam in either Hindi or English while around 1.25 lakh to 1.50 lakh students appeared in eight vernacular languages.

Apart from English and Hindi, CBSE held NEET 2017 Examination in 10 languages, including Bengali, Tamil, Telugu, Marathi, Assamese, Gujarati, Oriya and Kannada.

The CBSE said that the decision to have different question papers in vernacular languages different from those in English and Hindi was to ensure that in the event of any leak of question papers in vernacular languages, it would not lead to cancellation of the entire NEET 2017 examination.
