Hearing Detail of Plea Challenging Centre’s ordinance on NEET(12-07-2016)

Today Supreme Court Judge L. Nageswara Rao avoid himself from hearing a plea that challenged Centre’s ordinance on NEET. The hearing has now been adjourned to 14th July 2016. Justice Nageswara Rao makes it clear that he will not hear cases related to NEET because he earlier appeared as lawyer for Tamil Nadu state against NEET.

After Justice Rao’s recusal, it is expected that another judge will sit with Justice Anil Dave to hear the case on 14th July 2016.
A petition was filed seeking quashing of central government’s ordinance which allows states to continue with their separate entrance tests for MBBS and BDS courses.

History of Plea Challenging Central Government’s ordinance on NEET

Earlier in the month of May a vacation bench of justice PC Pant and justice DY Chandrachud in Supreme Court had refused to stay NEET ordinance and mentioned the case before Chief Justice of India T.S Thakur in July.Vacation bench said that time, Lets us not create further confusion on entrance examination among students and let students appear for test with certain amount of certainty.

On July 4, the plea came up before CJI T.SThakur, and it was disclosed that the matter will be listed before a Bench headed by Justice Dave on 7th July. But, that day turned out to be a court holiday due to Eid festival, and hence the plea was pushed to today. Now, with Justice Rao’s recusal, the plea will be heard on 14th July 2016.

Students should focus on NEET Phase2 and Stop Spreading Rumours

Many students were confused and sending messages on Entrance Mantra’s Facebook page that whether NEET Phase2 will conduct on 24 July or it would postpone . Entrance Mantra’s team wants to clear that as of now NEET Phase2 will conduct as per schedule on 24th July 2016.

Q1)What are the chances of quashing  central government’s ordinance by Supreme Court?
Ans- We don’t think that Supreme Court would quash  central government’s ordinance, because this will create panic among students. Most importantly in many states of South India counselling has been done for MBBS and BDS admission.

Q2)Will NEET Phase2 conduct as per schedule?
Ans- CBSE will conduct NEET Phase2 as per schedule on 24th July 2016. Students should focus on their studies as this is very crucial time for exam preparation.

Who is L.Nageswara Rao?

L. Nageswara Rao was a Senior Advocate and former Additional Solicitor General of India. He was also a member of the Supreme Court-appointed Committee headed by Justice Mukul Mudgal, which had probed the IPL spot-fixing and betting scandal.
L. Nageswara Rao had appeared and argued for Tamil Nadu in the NEET case on 3rd May 2016, his name also mentioned as advocate in Entrance Mantra’s 3rd May post.
